1. Definitions
Welcome to EazzyBook. These Terms & Conditions ("Terms") govern your access to and use of the EazzyBook platform, website, applications, services, APIs, forms, booking pages, subdomains, and related features (collectively, the "Service"). By accessing or using EazzyBook, you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Service immediately. EazzyBook, we, our, or us refers to EazzyBook and its operators. User, Customer, Business, or Account Holder refers to any individual or organization using the Service. Platform refers to the EazzyBook website, software, applications, APIs, and related services. Subscription refers to any paid plan purchased through EazzyBook. Content refers to any data, forms, bookings, customer information, images, text, files, or other materials uploaded or generated through the Platform.
2. Service Description
EazzyBook provides software solutions that may include online appointment booking, customer management, form creation and submissions, team and staff scheduling, booking pages and hosted forms, automated notifications and reminders, analytics and reporting, payment integrations, and marketing and customer engagement tools. We reserve the right to modify, add, or remove features at any time.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using EazzyBook, you represent and warrant that you satisfy these requirements.
4. User Accounts
To access certain features, you may be required to create an account. You agree to provide accurate and complete information, maintain the security of your login credentials, promptly update account information when necessary, and accept responsibility for all activities conducted under your account. You are solely responsible for any actions performed by employees, contractors, staff members, or other users authorized under your account.
5. Subdomains and Hosted Pages
EazzyBook may provide hosted pages and subdomains, including but not limited to yourbusiness.eazzybook.com. You are granted a limited, non-transferable, revocable license to use such hosted resources. EazzyBook reserves the right to suspend, modify, reclaim, or remove subdomains that violate intellectual property rights, mislead users, impersonate another business, promote unlawful activities, or violate these Terms.
6. Subscription Plans and Billing
Certain features require a paid subscription. By purchasing a subscription, you authorize EazzyBook to charge the selected payment method on a recurring basis according to your billing cycle. Subscriptions may be offered on monthly or annual billing. Unless canceled before the renewal date, subscriptions will automatically renew. Failure to make payment may result in suspension or termination of paid features.
7. Refund Policy
Subscription fees are generally non-refundable. Refunds, if any, shall be granted solely at EazzyBook's discretion or where required by applicable law. Unused subscription periods are not eligible for partial refunds.
8. User Responsibilities
You agree to use the Platform responsibly and lawfully. You are responsible for managing your bookings and customers, maintaining accurate information, obtaining any required customer consents, complying with applicable laws and regulations, and ensuring that your content does not violate third-party rights.
9. Prohibited Activities
You may not use EazzyBook to conduct illegal activities, distribute malware or harmful code, send spam or unsolicited communications, engage in phishing or fraud, collect sensitive personal information unlawfully, promote unauthorized adult services, violate intellectual property rights, attempt unauthorized access to systems or data, or reverse engineer, copy, or exploit the Platform. Violation of this section may result in immediate suspension or termination.
10. Data Ownership
You retain ownership of all customer data, booking data, form submissions, and other content you upload to the Platform. EazzyBook does not claim ownership of your business data. You grant EazzyBook a limited license to process, store, transmit, and display such data solely for the purpose of providing the Service.
11. Privacy and Data Protection
Our collection and use of information are governed by our Privacy Policy. By using the Service, you consent to the collection, processing, and storage of data as described in the Privacy Policy.
12. Third-Party Services
The Platform may integrate with third-party services, including payment gateways, email providers, communication tools, analytics providers, calendar systems, and other external platforms. EazzyBook is not responsible for third-party service availability, service interruptions, data handling practices of third parties, or errors caused by third-party systems. Your use of third-party services is subject to their respective terms and policies.
13. Intellectual Property
All rights, title, and interest in the Platform, including software, designs, trademarks, branding, logos, documentation, and proprietary technology, remain the exclusive property of EazzyBook. Nothing in these Terms grants ownership rights to any user.
14. Service Availability
While we strive to maintain reliable service, EazzyBook does not guarantee uninterrupted or error-free operation. The Platform may experience maintenance periods, system upgrades, network interruptions, or third-party outages. We are not liable for losses resulting from temporary service disruptions.
15. Account Suspension and Termination
We reserve the right to suspend or terminate accounts at our discretion for reasons including violation of these Terms, fraudulent activity, non-payment, abuse of platform resources, security risks, or illegal activities. Upon termination, access to the Service may be revoked immediately.
16. Data Retention and Deletion
Following cancellation or termination of an account, EazzyBook may retain account data for a limited period for operational, legal, compliance, backup, or recovery purposes. After the retention period, data may be permanently deleted without further notice. Users are responsible for exporting any required data before account termination.
17. Limitation of Liability
To the maximum extent permitted by law, EazzyBook, its directors, employees, affiliates, partners, and service providers shall not be liable for lost profits, lost revenue, lost business opportunities, loss of data, business interruption, or indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you to EazzyBook during the preceding twelve (12) months.
18. Indemnification
You agree to indemnify and hold harmless EazzyBook, its employees, affiliates, and partners from any claims, damages, liabilities, costs, or expenses arising from your use of the Platform, violation of these Terms, violation of applicable laws, or infringement of third-party rights.
19. Changes to the Service
EazzyBook may modify, suspend, or discontinue any feature, functionality, or portion of the Service at any time without prior notice.
20. Changes to These Terms
We may update these Terms periodically. Continued use of the Service after revised Terms are published constitutes acceptance of the updated Terms.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India.
22. Force Majeure
EazzyBook shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including natural disasters, government actions, internet failures, cyberattacks, power outages, cloud infrastructure failures, or labor disputes.
